Driving Under The Influence

Our criminal defense attorneys, including Nathan Evershed who formerly worked as a prosecutor, have collectively handled countless DUI cases, including through trial. We know DUI cases inside and out and can help you make good decisions about your future. Our know-how can help you weigh and examine the strengths and weaknesses of a case, negotiate with the government, and determine if a plea offer is reasonable. Based on upon our experience, we also know when to take a case to trial if that’s the best solution.

Driving Under the Influence - DUI

Of course, the easiest way to avoid DUI is to not drink and drive, but if you or a loved one is facing DUI charges, here are some helpful answers.

What is Utah law regarding DUI?

In order to be convicted of DUI, the prosecution has the burden to prove beyond a reasonable doubt that:

The driver was in actual physical control of a car; and Either:

  • Had blood or breath alcohol concentration of .05 grams or greater at the time of the test or at the time of actual physical control of the car; or
  • The driver was under the influence of alcohol, any drug, or the combined influence of alcohol and any drug to a degree that renders the person incapable of safely operating a vehicle.

If the government cannot prove all elements beyond a reasonable doubt, then the driver could not be convicted. It’s the government’s burden to prove all elements of a crime beyond a reasonable doubt.

What are the penalties for DUI?

The penalties for DUI vary depending on whether anyone was injured, if young passengers were in the car, if there are prior convictions for DUI or impaired driving, and even the level of BAC can impact penalties.

An experienced criminal attorney can advise you of your rights, the strength or weaknesses of the government’s case, and the possible outcomes, including pleading to a lesser charge or straight dismissal.

What is Impaired Driving?

Impaired driving is an alternative to a DUI conviction and does not carry the same strict sentencing requirements of DUI.

Why hire an experienced criminal attorney?

A DUI conviction has a severe impact on people’s lives. You are looking at jail time, court fines, and a suspended drivers’ license – impacting your freedom, pocketbook, and ability to get to work or school.
