In order to be convicted of DUI, the prosecution has the burden to prove beyond a reasonable doubt that: 

The driver was in actual physical control of a car; and Either:

  • Had blood or breath alcohol concentration of .05 grams or greater at the time of the test or at the time of actual physical control of the car; or 
  • The driver was under the influence of alcohol, any drug, or the combined influence of alcohol and any drug to a degree that renders the person incapable of safely operating a vehicle. 

If the government cannot prove all elements beyond a reasonable doubt, then the driver could not be convicted. It’s the government’s burden to prove all elements of a crime beyond a reasonable doubt.

The penalties for DUI vary depending on whether anyone was injured, if young passengers were in the car, if there are prior convictions for DUI or impaired driving, and even the level of BAC can impact penalties.
